My father passed away in 2002. I never lived with him or knew
him (i'am in my 40's). He lived in the Bronx,NY....i live on long island. Before he passed my sister started making weekly trips to the Bronx. Soon i learned she took Power of Attorney over his life. After his death,my sister who has always been buried in deep debt, suddenly becomes the great investor.
Buying a house, cars, time-sharing property,trips around the world,etc. Her kindness towards me was lunch at Burger King (no joke). She told everybody my father had no will, I checked on somethings and found a trail of lies, I don't have any money for an attorney to investigate. What do you recommend??

I have worked for an attorney, and I definately think it is worth getting one even if you have to borrow money, or work something out with them, some may do contiengacy ( pay after settlement) Even thou she had power of attorney she still has a responsiblity to do what is right for the estate, excessive spending on herself is illegal as it is not in your father's best interest or his estate when he was alive. Even if he didnt have a will, you are still entitled to a portion of the estate being a biological child, you need to protect those rights. If he didnt have a will, by law she has no right to touch any of the assets of the estate, power of attorney is no longer valid once a person passes away. The estate would of gone into probate and the state should have decided how the divison of the assets should proceed. Hope that helps some.
Talk to an attorney. There are plenty of them that will accept your case and wait until the settlement to recieve thier fees. The fees will usually be a percentage of whatever you get. A second option would be to check into legal aid. Most states have an organization of attorneys who take really indigent cases pro-bono.My sister is suddenly rich!!!!?
Check at the court and see if there is will on file. If so I believe just because she had power of attorney. She would have to file through probate court in order to do any thing to settle is estate. Just check the court

I agree, find a lawyer who will dig into her lies and who can possibly try to challenge the estate. Fair is fair, you're his daughter too.
Find the money for an attorney it is really the only thing that will help, you will get no where investigating yourself.
I recommend you move on with your life. I'm not saying your sister deserves what he got. But your being jealous and trying to get some of it will only cause you pain.

Christian B is right. listen to this advice, get a lawyer. Sounds like there was a will because she is trying to hide something.Perhaps you were named in the will and she is now saying there was no will. However she doesn't realize that this only really means you are still in titled to your "fair share" and you are an heir to your father's estate. Any monies your sister has spent so far,(if proven in your favor could be forced to be paid back) so this is why you need a lawyer. And as for those who think you are not entitled to the estate because of your relationship with your Dad, they are mistaken, this is the law. If there is no will, all heirs must share and share alike,it's the law. So it is highly recommended that people should make a will. good luck, I hope you get what if rightfuly yours.
